Governing the use of the FinUties API and website

1. Service Description
FinUties ("the Service", "we", "us") provides a financial data API that aggregates publicly available data from regulatory agencies, central banks, statistical offices, and market data sources. The Service is accessible via:
- REST API at
data.finuties.com/api/v1/ - MCP endpoint (Model Context Protocol) at
data.finuties.com/mcp/jsonrpc - Web interface at
finuties.com(dashboard, analysis tools)
By accessing or using the Service, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Account Registration
To use the API, you must create an account. You agree to:
- Provide accurate and complete registration information
- Keep your login credentials, API keys, and bearer tokens confidential
- Notify us immediately of any unauthorized use of your account
- Be responsible for all activity under your account
We reserve the right to suspend or terminate accounts that violate these terms.
3. API Usage and Token System
3.1 Tokens
The FinUties API operates on a token-based billing system:
- Each API call consumes tokens based on endpoint complexity (typically 1–10 tokens)
- Token pricing is displayed in EUR on the pricing page and account dashboard
- Promotional onboarding allocations may be offered during early access, as communicated on the platform
- Promotional offers and referral bonuses may provide additional tokens
Token consumption is tracked in real time. API responses include request-cost headers such as X-Request-Tokens and X-Request-Cost-EUR for transparency.
3.2 Rate Limits
API access is subject to rate limits to ensure fair usage and service stability:
- Default: 100 requests per minute per IP address
- Per-user rate limits may apply based on your subscription tier
- Rate limit information is provided in response headers (
X-RateLimit-Limit,X-RateLimit-Remaining)
Exceeding rate limits results in HTTP 429 responses. Repeated or intentional rate limit violations may result in account suspension.
3.3 Token Balance
When your token balance reaches zero, API requests that consume tokens will be rejected. You may purchase additional tokens or wait for promotional allocations. Free tokens do not expire unless explicitly stated in a campaign.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these terms. Specifically, you must not:
- Redistribute, resell, or sublicense the API data without prior written consent
- Attempt to circumvent rate limits, authentication, or billing mechanisms
- Use the Service for any illegal purpose or in violation of applicable laws
- Overload the Service through excessive automated requests beyond your rate limits
- Reverse engineer, decompile, or disassemble the Service software
- Use the API data to create a competing service without permission
- Misrepresent the data as your own proprietary data when sharing with third parties
5. Intellectual Property
5.1 Our Property
The FinUties platform, API design, documentation, website, and all related software are the intellectual property of Sebastian Becker. All rights are reserved.
5.2 Data Sources
The data served through the FinUties API is primarily sourced from publicly available government and institutional databases, including:
- U.S. Securities and Exchange Commission (SEC EDGAR)
- U.S. Commodity Futures Trading Commission (CFTC)
- U.S. Bureau of Labor Statistics (BLS), Bureau of Economic Analysis (BEA), Energy Information Administration (EIA), Census Bureau
- U.S. Federal Reserve, U.S. Department of the Treasury, Federal Reserve Bank of New York
- European Central Bank (ECB), Eurostat, OECD, IMF, World Bank
This data is in the public domain or publicly available. FinUties does not claim ownership of the underlying data. Our value-add is the aggregation, normalization, and serving infrastructure.
5.3 Your Data
You retain ownership of any data you upload or create through the Service (e.g., saved queries, analysis configurations). We do not claim any intellectual property rights over your user-generated content.
6. Availability and Service Level
We strive to maintain high availability of the Service, but we do not guarantee uninterrupted access. Specifically:
- The Service is provided on a best-effort basis
- We do not offer a formal Service Level Agreement (SLA) at this time
- Planned maintenance will be communicated in advance when possible
- Data freshness depends on the publication schedules of the underlying sources (SEC, CFTC, central banks, etc.)

7. Limitation of Liability
7.1 No Financial Advice
FinUties does not provide financial, investment, tax, or legal advice. The data is provided for informational and research purposes only. You are solely responsible for any decisions made based on data obtained through the Service.
7.2 Data Accuracy
Data is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that:
- The data is complete, accurate, or error-free
- The data will be available at all times without interruption
- The Service will meet your specific requirements
7.3 Liability Cap
To the maximum extent permitted by applicable law, the operator's total liability for any claims arising out of or related to the Service shall not exceed the amount you have paid to us in the 12 months preceding the claim, or CHF 100, whichever is greater.
7.4 Exclusions
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, regardless of the cause of action.
8. Termination
- By you: You may stop using the Service at any time. You may request account deletion by contacting us. Unused tokens are non-refundable unless required by applicable law.
- By us: We may suspend or terminate your account for violation of these terms, non-payment, or for any reason with 30 days' notice. In cases of severe abuse, we may terminate immediately.
- Effect of termination: Upon termination, your access to the API will be revoked. Your usage data will be retained for 12 months for accounting and legal compliance purposes, then deleted.
9. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions. For EU consumers, mandatory consumer protection provisions of the consumer's country of habitual residence apply in accordance with Art. 6(2) of the Rome I Regulation.
10. Dispute Resolution
In the event of a dispute arising from these terms:
- Step 1: The parties shall attempt to resolve the dispute through good-faith negotiation within 30 days.
- Step 2: If negotiation fails, the dispute shall be submitted to the competent courts in Konstanz, Germany, or, once the legal seat has been established in Switzerland, the competent Swiss courts.
For EU consumers: Nothing in these terms affects your statutory rights under applicable EU consumer protection law, including your right to bring proceedings in the courts of your place of residence.
11. Changes to These Terms
We may update these Terms of Service from time to time. Material changes will be communicated with at least 30 days' notice before they take effect. Notice will be provided via:
- Email notification (if you have an account with an email address)
- A prominent notice on the FinUties website
- Updated "Last updated" date at the top of this page
Continued use of the Service after the effective date of updated terms constitutes acceptance of those terms.
12. Right of Withdrawal (EU Consumers)
If you are a consumer within the European Union, you have a 14-day right of withdrawal from the date of contract conclusion (account registration), in accordance with Art. 9 of the EU Consumer Rights Directive (2011/83/EU).
To exercise this right, send a clear statement of withdrawal to [email protected].
Exception for digital services: If you have explicitly consented to the performance of the service beginning before the end of the withdrawal period (e.g., by making API calls or consuming tokens), and you have acknowledged that you thereby lose your right of withdrawal, the right of withdrawal expires once the service has been fully performed. By using API tokens after registration, you consent to immediate performance and acknowledge the loss of withdrawal rights for the tokens consumed.
13. Force Majeure
Neither party shall be liable for any failure or delay in performing obligations under these terms to the extent that such failure or delay results from events beyond the reasonable control of the affected party, including but not limited to: natural disasters, acts of government, internet or telecommunications failures, power outages, or disruptions to upstream data sources (SEC EDGAR, CFTC, central banks, etc.).
14. Miscellaneous
- Severability: If any provision of these terms is found unenforceable, the remaining provisions remain in full force.
- Entire agreement: These terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and FinUties.
- No waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
- Assignment: You may not assign your rights under these terms without our prior written consent.
